SMS Terms
1. About This Program
Cloud Health Technologies, LLC, d/b/a Cloud Anesthesia ("Cloud Anesthesia," "we," "us," or "our") operates an optional text-message notification program (the "SMS Program") for Authorized Users of the Cloud Anesthesia scheduling service (the "Service"). These SMS Terms govern that program. They supplement, and do not replace, our Terms of Service and Privacy Policy.
Messages are sent from our toll-free number +1 (844) 981-2134.
1.1 Who This Program Is For
The SMS Program is available only to Authorized Users of the Service — typically anesthesiologists, CRNAs, anesthesiologist assistants, schedulers, and administrative staff at a medical practice or facility that subscribes to Cloud Anesthesia. It is not open to the general public, and we do not send text messages to patients.
You must be at least eighteen (18) years old and the owner or authorized regular user of the mobile number you enroll.
2. What Messages You Will Receive
If you enroll, we send operational text messages about your own work schedule. These include:
- Notice that a schedule covering you has been published or republished
- Changes to a case or shift you are assigned to, including additions, reassignments, and cancellations
- Time-sensitive facility or practice notifications relevant to your assignments
This is a recurring messages program. We do not send marketing, advertising, or promotional text messages through this program, and we do not sell or share your mobile number with third parties for their own marketing.
2.1 Message Frequency
Message frequency varies and depends on how often your practice publishes or changes schedules. Most users receive fewer than five (5) messages per week. There is no fixed or guaranteed number of messages.
2.2 Cost
Message and data rates may apply. Cloud Anesthesia does not charge you for these messages, but your mobile carrier may charge you for sending or receiving text messages depending on your plan. Contact your carrier for details about your plan.
2.3 Message Content and Patient Information
Text messages in this program are deliberately kept minimal. They tell you that a schedule or assignment affecting you has changed and direct you to sign in to the Service to see the detail. We do not include patient names, patient identifiers, procedure detail, or other protected health information in text messages. Case-level information is available only after you authenticate to the Service.
3. How to Enroll (Consent)
Enrollment is entirely opt-in and is performed by you, from your own account:
- Sign in to the Service.
- Open Notifications from your profile menu.
- Enter your mobile number and check the box consenting to receive text messages.
- Save.
Checking that box is your express written consent to receive recurring automated text messages from Cloud Anesthesia at the number you provide.
Consent is not a condition of purchase, of employment, or of using the Service. You can use every feature of Cloud Anesthesia without ever enrolling in text messages, and email notification is available as an alternative. Your employer or practice administrator cannot enroll you in text messages on your behalf — only you can turn this on, from your own signed-in account.
We record the date, time, IP address, and browser of each opt-in and opt-out so we can evidence your consent.
4. How to Opt Out
You may stop receiving text messages at any time, by either method:
- Reply STOP to any message we send you. You will receive one final message confirming that you have been unsubscribed, and we will send no further messages to that number.
- Turn it off in the Service, on the same Notifications page where you enrolled.
These two methods are not interchangeable when you want to come back. If you opt out by replying STOP, your mobile number is added to a block list held by our messaging provider, and you must reply START to that same number to resume. Turning the setting back on in the Service will not restart delivery on its own while that block is in place. If instead you opted out by turning the setting off in the Service, simply turn it back on.
Opting out of text messages does not remove you from the Service or from email notifications, which are managed separately.
5. How to Get Help
Reply HELP to any message for assistance, or contact us at info@cloud-anesthesia.com.
For questions about these SMS Terms, contact legal@cloud-anesthesia.com. For questions about how we handle your personal information, contact privacy@cloud-anesthesia.com.
6. Carriers and Delivery
Text message delivery depends on your mobile carrier's network and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages. Messages may be delayed or fail to arrive for reasons outside our control, including network outages, device settings, coverage gaps, and carrier filtering.
Because delivery is not guaranteed, you should not rely on text messages as your only source of schedule information. The Service itself is the authoritative record of your schedule and assignments. Always confirm your assignments by signing in.
Supported carriers may change at any time, and we may add, change, or discontinue the SMS Program without notice.
7. Your Mobile Number
You agree to provide a mobile number that you own or are authorized to use, and to keep it current in the Service. If you give up, change, or transfer that number, you agree to update or remove it in the Service promptly, so that messages intended for you are not sent to someone else.
We use your mobile number for the notifications described in §2 and for nothing else. We share it with our messaging provider solely to transmit those messages. See our Privacy Policy for how we handle personal information generally, including your rights over it.
8. Changes to These Terms
We may update these SMS Terms from time to time. The "Last Updated" date above reflects the most recent change. If we materially change what the program sends or how it works, we will provide notice through the Service before the change takes effect. Continuing to receive messages after a change takes effect means you accept the updated terms.
